Class B misdemeanor – Carries a maximum three-month jail term and a fine not exceeding $500 or double the amount the defendant profited from the alleged offense.

Unclassified misdemeanor – This type of misdemeanor carries specific penalties based on the underlying crime. For example, reckless driving is punishable by a maximum 30-day jail sentence and a fine of up to $300.

What is a Felony in New York?

Felonies, on the other hand, are more serious than misdemeanors. These crimes carry a potential prison sentence of over a year.

NY Felony Classifications & Penalties

NY felony classes include:

Class A-I felony – Punishable by life imprisonment with a minimum sentence ranging from 15 to 25 years.

Class A-II felony – Punishable by life imprisonment with a minimum sentence ranging from three and eight years and four months.

Class B felony – Punishable by up to 25 years in prison with a minimum term ranging from one year to a third of the maximum sentence.

Class C felony – Punishable by up to 15 years in prison with a minimum term ranging from one year to a third of the maximum sentence.

Class D felony – Punishable by up to seven years in prison with a minimum term ranging from one year to a third of the maximum sentence.

Class E felony – Punishable by up to four years in prison with a minimum term ranging from one year to a third of the maximum sentence.
